Submitting an entry constitutes your full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which shall be final and binding on all matters relating to the Giveaway.

 

1. Giveaway Timing: The Venus x Bang.Ink Giveaway (the “Giveaway") begins 2:00 p.m. Eastern Time (“ET”) on September 23, 2020 and ends 11:59 p.m. ET on September 26, 2020 (the "Giveaway Period").

2. Eligibility: The Giveaway is open only to legal residents of the United States, who are 18 years of age or older as of the last day of the month prior to the date of entry. Employees of The Procter & Gamble Distributing LLC (the "Sponsor") and their respective parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional agencies, and their immediate family members (spouses, parents, children, and siblings and their spouses) and household members of each (whether related or not), are not eligible to participate or win. Void outside the Eligibility Area and where prohibited by law. All federal, state, and local laws and regulations apply.

3. How to Enter the Giveaway: There is one method of entry on Instagram:

 

• • You must have an Instagram account and have your account setting set to public (not private).

  • You must follow my Instagram account (@bang.ink)

  • You must follow the Gillette Venus Instagram account (@GilletteVenus).

  • You must like the Instagram Post.

  • In the comments of the Instagram Post, comment “✍️” and why you are interested in winning a free tattoo appointment and what the tattoo would mean to you.

  • You must be willing to share your tattoo story and experience on an Instagram post on my Instagram (@bang.ink)

  • You must be willing to sign a release form and have your tattoo process and final tattoo photographed and shared on my Instagram (@bang.ink)

 

Limit one entry per person on Instagram during the Giveaway Period. By including Content during the Giveaway, you acknowledge that you are a legal resident of a state within the Eligibility Area, who is 18 years of age or older, and you have read and agree to these Official Rules. Any Content deemed inappropriate or containing unsuitable material, in Sponsor’s sole discretion will be disqualified. Any Content or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory or violates any proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, sexual in nature, or is otherwise objectionable, will disqualify the entry as determined in Sponsor’s sole discretion. Entry must be in keeping with Sponsor’s image and may not be offensive, as determined by Sponsor in its sole discretion. If you enter using your mobile phone, standard data fees/rates may apply. See your wireless provider for pricing plan details. Entries generated by script, macro or other automated means and entries by any means which subvert the entry process are void. Instagram and Facebook are not affiliated with the Giveaway in any way and are not responsible for the administration of the Giveaway or the awarding of the prizes. No endorsement or approval of Giveaway by Instagram or Facebook is expressed or implied. All entries become the sole property of the Sponsor. Entrant posts relating to the Giveaway represent solely the views and opinions of the individual entrant and do not reflect the views and opinions of the Sponsor in any manner. The Sponsor acts as a passive conduit for the posting and publication of such Content and has no obligation to screen, monitor or review the content of posts and entries relating to the Giveaway and expressly disclaims any and all liability in conjunction with any such activities.

 

Rights: Once submitted, Content becomes the sole property of Sponsor (subject only to the rights of Instagram and Facebook) and cannot be modified by entrant. By submitting an entry, each entrant gives permission (and warrants and represents that he/she has obtained all rights necessary from third parties to give such permission and grant the license herein described) to Sponsor and its licensees, sublicensees, successors, and assigns (collectively, the “Rights Holders”), the exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable, sublicenseable right and license (including but not limited to, all intellectual property and proprietary rights including without limitation patents, trademarks, and copyrights) to use, perform, exhibit, reproduce, manufacture, construct, tailor, distribute, sell, offer to sell, import and/or otherwise exploit the entry/Content in any manner and in any and all distribution channels, venues or media now known or hereafter devised (collectively, the “License”). The rights granted pursuant to the License shall also include, without limitation, the right to: (a) change, alter, distort, edit or revise the entry/Content, or any part thereof; and (b) make derivative works based on the entry, or any part thereof. Entrant agrees to sign any documents required by Sponsor upon request (and without compensation) to confirm such License. The preceding grant of rights is expressly made subject to any rights retained by Instagram or Facebook. Entrant further agrees that (a) Sponsor does not owe him/her a duty of confidence (or fiduciary duty or the like) and that he/she has no expectation of privacy as to his/her entry and (b) Sponsor has wide access to ideas, stories, designs and other literary/artistic materials submitted to it from outside sources or being developed by its own employees and that such ideas/stories/designs/literary/artistic materials may be competitive with, similar to (or even identical to) his/her entry and that Sponsor shall have no liability to entrant or any third party in conjunction therewith.

 

Sponsor grants to each qualified entrant a limited, non-transferable, non-exclusive, non-sublicensable, revocable right to use its and/or its licensor's trademarks solely for purposes of and limited to their entry submitted in this Giveaway; such right and license will automatically expire without further act of any party at the expiration of the Giveaway Period, unless specifically extended on an individual basis by Sponsor in writing in its sole discretion. Any other use of Sponsor’s and/or its licensors’ trademarks will be a violation of Sponsor’s or its applicable licensors’ intellectual property rights.

Awarding the Prize: 10 entries received during the Giveaway Period will be chosen by random by a random number generator and awarded one redeemable tattoo from the tattoo flash sheet. Awarding the prize will be conducted by Chavonna Rhodes. Subject to verification of eligibility and compliance with these Official Rules, potential winners will be declared the official winners of the Giveaway.

 

Winner Notification: The potential winners will be notified via direct message from @bang.ink on Instagram. The Direct Message will include the contact information of @bang.ink in order to schedule a tattoo appointment. The potential winners will need to respond to confirm acceptance of the prize within forty-eight (48) hours from the Direct Message being sent. If the potential winner does not respond within the forty-eight (48) hour timeframe of the Direct Message, an alternate will be randomly selected from among all eligible entries received, in first come, first served order. 

 

1. Prize and Approximate Retail Value ("ARV"): Prize is one (1) redeemable tattoo valued at approximately $200.00. Each winner be notified by 11:59PM EST September 29, 2020 . Certain restrictions may apply. No transfer, substitution or cash equivalent for prize will be permitted, except at the sole discretion of the Sponsor and in such circumstance, an alternate prize of equal value (as determined solely by Sponsor) will be awarded and the Sponsor’s obligation to the winner will be fulfilled, and no other additional compensation will be provided. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winners’ names and/or likenesses for purposes of advertising and trade without further compensation, unless prohibited by law. 

2. General Rules: By participating in the Giveaway, entrants agree to be bound by these Official Rules and the decisions of the Sponsor. Sponsors decisions are final on all matters relating to the Giveaway. The Sponsor and its agencies are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the Giveaway or by any human error which may occur in the Giveaway. Sponsor reserves the right to cancel the Giveaway if any aspect of the Giveaway becomes technically corrupted, and select the potential Grand Prize winners from among all eligible entries received prior to cancellation. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Giveaway; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any person responsible for the attempt to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. By participating in the Giveaway, you agree that the Sponsor, its agencies, and each of their respective affiliates, officers, directors, agents, and employees and Instagram and Facebook will have no liability or responsibility for any claim arising in connection with participation in the Giveaway or the awarding of a Grand Prize (or any portion thereof).

3. Release: By participating in the Giveaway, the entrant agrees that Sponsor, (The Procter & Gamble Distributing LLC), and their respective parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies (collectively, “Giveaway Entities”), Instagram, Facebook and each party’s respective affiliates, officers, directors, agents, and employees will have no liability or responsibility for any claim arising in connection with participation in the Giveaway or the awarding of a Prize (or portion thereof). Prize winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in the Giveaway or use or redemption of Prize (or portion thereof). By entering the Giveaway, you acknowledge that you, not Sponsor, are responsible for the contents of any material submitted in relation to the Giveaway. Entrants waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. You hereby agree that the Giveaway Entities have the right to use entrant’s name, likeness or any other rights granted to Sponsor, including any claims, including but not limited to, trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation in Sponsor’s, as applicable, sole discretion.

4. Disputes: You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or a Grand Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Ohio. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules (whether of the State of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Ohio.
